There are 3 bedrooms and 3 bathrooms allowing this home to comfortably accommodate 6-7 guests. The ground floor has the first bedroom with a queen size bed and a private bath. The second floor is where the kitchen is located, as well as the second bedroom, which has bunk beds. The bottom bunk is a full and the top is a twin. This accommodates 3 comfortably. The third floor is where the master bedroom and bathroom are located. There is a queen-sized bed in the master as well as a private entrance from the side of the house.

The upper deck is a relaxing haven. Guests can enjoy their morning coffee and watch the waves, or have an evening cocktail and watch the nightly fireworks at SeaWorld!

    CANCELLATIONS AND CHANGES IN RESERVATIONS.  All cancellations must be submitted to Owner in writing.  If written cancellation is received by Owner, and the unit is re-rented for entire reservation period, Tenant will be refunded any payment made, less a two hundred fifty ($250) cancellation fee.  If unit is not re-rented for entire reservation period, all payments will be forfeited.  If a change in reservation is required, Owner will make reasonable efforts to accommodate the change and a $100 fee will be assessed.

    1.  CHECK-IN TIME.  Check-in begins NO EARLIER than 3:00 pm on the arrival date unless prior arrangements have been made with Owner.  

     

    2.  SECURITY DEPOSIT.  Tenant agrees to be responsible for any and all damages that are caused by Tenant and within Tenant’s control to Property, its contents, and grounds during the tenancy period.  If there are problems with the unit as a result of Tenant’s actions or inactions, a full accounting will be made to Tenant, and an amount necessary to cover the problems will be billed to Tenant.

     

    2a.  COMMON AREA USE:  A gas grill will be provided.  Propane may be the responsibility of the tenant wishing to use the grill.  Any tenant using the grill is expected to thoroughly clean the grill after each use, or your Security Deposit may be forfeited.  As this is a shared patio with the other six units, courtesy is expected.  Please report any inappropriate use to Owner.

     

    3.  CHANGES TO PROPERTY:  Tenant shall not make any material or structural alterations to the leased premises without Owner’s written consent.

     

    4.  SMOKE DETECTORS.  Tenant is required to reset all smoke detectors upon check-in and promptly report inoperative smoke detectors to Owner.

     

    5.  PROPERTY INSPECTIONS.  All problems, including inadequate cleaning and damages, must be reported in writing to Owner within twenty-four (24) hours of check-in for prior guests to be held responsible.  Owner reserves the right to enter premises at any time for the purpose of effecting necessary inspections, repairs, or maintenance.

     

    6.  CHECK-OUT TIME.  Check-out is NO LATER than 10:00 am on the departure date.  In the event of a late check-out,  a fee of $100 may be assessed.   Upon vacating the premises, please make sure all doors and windows are locked, heating units are turned off, and beach equipment, including beach towels are washed and put away, dishwasher is loaded and turned on, and kitchen trash is removed. 

     

    7.  OCCUPANCY.  The maximum number of occupants allowed to reside in the property is six (6), unless prior written arrangements are made with Owner.  Children, including babies of all ages, are counted in this number, and OVERCROWDING OR MISREPRESENTATION IS GROUNDS FOR IMMEDIATE EVICTION WITHOUT REFUND.

     

    8.  RESTRICTIONS ON PROPERTY USE.  Tenant and occupants are prohibited from engaging in any unlawful activity or other activity that constitutes a nuisance.  Parties are strictly forbidden, along with loud music, or excessive traffic in or around the unit.  VIOLATION OF THIS PROVISION WILL RESULT IN IMMEDIATE EVICTION WITHOUT REFUND, INCLUDING THE SECURITY DEPOSIT, AND TENANT WILL BE HELD LIABLE FOR ANY DAMAGE TO THE UNIT, ITS CONTENTS AND GROUNDS.  Owner does not rent to individuals under 25 years of age, and reserves the right to require official picture identification showing date of birth.  “Quiet Times” are strictly enforced, and a noise complaint from another tenant may result in eviction without refund.  Units are expected quiet by 10:00 pm in the winter, and 10:00 pm during summer weeknights; 11:00 pm summer weekends.

     

    9.  PETS.  No pets are allowed on the property at any time without the prior written consent of Owner.  VIOLATION OF THE “NO PETS” STIPULATION IS GROUNDS FOR IMMEDIATE EVICTION WITHOUT REFUND.

     

    10.  SMOKING PROHIBITED.  The property is a “no smoking” unit.  Smoking includes, but is not limited to, cigarettes, pipes, cigars, and any other form of inhaled substance.

     

    11.  PERSONAL PROPERTY LOSS.  Tenant/occupants are solely responsible for personal property left in or about the Property, and Owner shall not be liable under any circumstances for damages to, or loss of any property.

     

    12.  PHONE USAGE.  Directly dialed long-distance calls, directory assistance calls, and incoming collect calls are prohibited.  If tenant engages in improper phone usage, the charges will be deducted from the Security Deposit.

    14.  SUBLETTING AND ASSIGNMENTS.  Tenant may not sublet or assign this agreement without Owner’s prior written consent.

     

    15.  PROPERTY USE.  Unit may not be used for any activity in violation of local, state, or federal laws, or California Insurance rules and regulations. 

     

    16.  ATTORNEY’S FEES.  If Owner employs legal counsel or a professional collection service for collecting any amounts due the Owner under this Agreement, Tenant shall be responsible for all costs of litigation and collection, including reasonable attorney’s fees.

     

    17.  LIMITATIONS ON RENTAL.  Owner will not be liable for circumstances beyond its control, including but not limited to appliances or heating failure, or other mechanical failure, unfavorable weather, disruption of utility services including cable television, any television/stereo or home theater defects, etc.  There will be no relocation, rental rate pro-ration or refund in the event of such circumstance, or for displeasure with unit or surroundings.  In the event Owner is unable to deliver said Property to Tenant under the Agreement because of property sale, property fire, mandatory evacuation, eminent domain, faulty maintenance, or “Act of Nature”, or if the property is unavailable because of construction delays or because of lack of utilities, Tenant agrees that Owner’s sole liability, as a result of any of these conditions, will be limited to full refund of all payments tendered by Tenant. 

     

    18.  INDEMNIFICATION.  Tenant agrees to release and indemnify Owner from and against all liability should anyone be injured upon the premises during the term of occupancy, resulting from any cause whatsoever, except in the case of personal injury caused by willful gross negligence on the part of the Owner.

     

    19.  OWNER CHANGES.  Every effort is made to ensure all information on our website is accurate and complete.  Owner is not liable for typographical errors, omissions, price changes, and any other changes by the Owner in furnishings, type of equipment, bed arrangements, and other accommodations.

     

    20.  EFFECTIVE DATE.  Not withstanding any other assurance to the contrary, this Occupancy Agreement is not binding or effective until signed by both parties and Owner receives a Reservation Deposit.

     

    21.  GOVERNING LAW.  The terms and conditions stated herein will be interpreted by and governed under the laws of the State of California, and any action arising out of this agreement shall be litigated in the City of San Diego, State of California.

     

    22.  OTHER ATTORNEY’S FEES.  In the event of any action or proceeding commenced by any party, the prevailing party in such action or proceeding shall be entitled to recover from the other party all costs and expenses thereof, including reasonable attorney’s fees and costs.

     

    23.  INVALID PROVISIONS.  If any provision of the Agreement is held to be illegal, invalid, or unenforceable under present or future laws effective during the term hereof, such provision shall be fully servable and this Agreement shall be construed and enforced as if such illegal, invalid, or unenforceable provision had never comprised a part hereof, and the remaining provisions hereof shall remain in full force and effect and shall not be affected by the illegal, invalid, or unenforceable provision or by its severance hereof.

     

    24.  ENTIRE AGREEMENT.  This Agreement set forth the entire understanding of the parties and supersedes all prior agreements or understanding, whether written or oral, with respect to the subject matter hereof.  No amendment or modification hereto shall be binding unless made in writing and signed by the parties hereto.

     

    25.  BINDING EFFECT.  This Agreement shall extend to and be binding upon and inure to the benefit of the parties hereto, their respective heirs, representatives, successors and permitted assigns; however, Tenant may not assign this Agreement.

     

    26.  WAIVER.  The waiver by either party hereto of a breach of any term or provision of this Agreement shall not operate or be construed as a waiver of a subsequent breach of the same provision by any party or of the breach of any other term or provisions of the Agreement.

     

    27.  HEADINGS.  Heading of the paragraphs herein are used solely for convenience and shall not be used for interpretation or construing any word clause, paragraph, or provision of this Agreement.

    Security deposit fully refunded within 30 days of departure.

    To receive full security deposit home must be returned in the same condition in which it was rented.

    EXCESSIVE PARTIES WILL RESULT IN IMMEDIATE EVICTION, AND TOTAL LOSS OF RENTAL PAYMENT AND SECURITY DEPOSIT! If you want to party, take it to the clubs!
